Terms of Purchase for individual consumers from the e-shop of KOTSINAS

1. Applicability of these Terms

These Terms and Conditions apply to the sale of goods by the online store (hereinafter "KOTSINAS") to individual consumers. If you wish to make a purchase as a professional, you should register with the specially designed B2B section of our online store.


By placing an order through our online store, you accept these terms and conditions.


2. Seller Information of the E-SHOP

The seller of this e-shop is the company named "A. KOTSINA LTD" (trading as KOTSINAS- GARDENING AGRICULTURAL TOOLS), located in Thessaloniki (Pyritsa Ionias Street, Zip Code 57008, Telephone: 2310781500, Email: [email protected]), hereinafter referred to as "KOTSINAS."


3. Sales Process


1. When you click the "Submit Order" button, it means you are sending a proposal to KOTSINAS to purchase the products in your cart and agree to the application of these General Terms of Purchase.


2. The confirmation of receipt of your purchase proposal, which is automatically sent immediately after submitting your order, certifies that your order has been received by KOTSINAS. However, this does not automatically constitute acceptance of your purchase proposal. Acceptance will only occur after the availability of the products you ordered is checked and verified. You will receive a separate confirmation email accepting your order. KOTSINAS explicitly reserves the right to accept or reject your proposal based on the availability of the selected products.


3. Any incorrect product entries or payment/shipping details provided by you do not burden KOTSINAS but are your responsibility.




4. Product Availability


1. If the products you order are not immediately available or are not available at the listed price due to a change in the listed price at the time of ordering and processing, KOTSINAS will inform you whether it accepts your order or not, as well as regarding availability and the applicable price or any delays in delivery. In case of non-acceptance, any payments made in such a case will be canceled, and a refund process will be initiated based on the chosen method of payment.


2. KOTSINAS checks the accuracy of the listed prices of its products on a daily basis. However, it explicitly reserves the right to rectify any incorrectly listed prices due to human or technical errors that could not reasonably represent the usual or average selling price of the respective product. KOTSINAS will inform you of any errors in the listed prices of the products you ordered and provide you with the correct price. Any payments made in such a case will be canceled.


In any case, you will be informed within 1 to 5 business days regarding the delivery time of your products.


5. Delivery - Delivery and Return Costs


1. Orders weighing up to 3 kilograms and with dimensions up to 23cmx23cmx23cm will be shipped via the designated courier service and will incur a shipping fee of €5.00 (including VAT) per order. Transportation of larger or heavier orders will be arranged through a shipping company of your choice, with charges borne by you. For orders with delivery to Cyprus, the shipping method and cost will be determined in consultation with the customer.

2. Upon completion of the order, which is scheduled for delivery through the designated courier service, you will receive a relevant email notification. Returns of products that are arranged and charged by us will only be accepted through our partnered transportation company, following prior coordination.

3. The processing and preparation of orders are typically completed within 1-5 business days, depending on the workload of KOTSINAS. The delivery time of the orders is solely dependent on the courier and shipping companies. However, it may also be influenced by the payment method you have chosen (e.g., the processing and appearance time of a bank transfer may vary depending on the bank, usually taking 2-3 business days).

4. The delivery of small orders that can be shipped via courier, once they have been accepted, will be carried out within 5 business days, if feasible, unless special circumstances affect the workload of the shipping companies and cause unexpected delays. In the case of remote or inaccessible areas, the shipment and delivery of your products may require additional time. In any case, the delivery of the order will not exceed 30 days, except in cases of force majeure (strikes, severe weather conditions, periods of high workload for the shipping companies, etc.). The delivery of larger orders that are shipped via a transportation company of your choice is subject to an agreement between you and your chosen transportation company.

5. The customer has the option to choose pickup from our premises as the delivery method for their order, at the Pyritsa Ionias location in Thessaloniki, upon prior arrangement with us regarding the exact pickup time.

6. Delivery Issues: Any quantity discrepancies or defective packaging will be accepted for inspection only if they are reported on the same day of receipt by the recipient.

7. The products travel at the buyer's expense and risk.


6. Payment Methods


You can pay for your order using a VISA or MasterCard credit/debit/prepaid card. All online card payments are processed in a secure protected environment provided by our payment service provider, to which you will be automatically redirected for payment processing. The data you enter during an online payment is not checked, processed, or stored by KOTSINAS but by the respective payment provider and/or payment server. Please note that the secure payment system may require you to confirm the transaction using two-factor authentication, such as sending you a written or electronic message with a unique code, provided that you already have electronic banking codes from the issuing bank of your card.

In this case, your order will be shipped on the next business day after the transfer appears in our account. The completion and appearance time of the bank deposit may vary depending on the bank (usually 2-3 business days). If the deposit is not made within 3 business days, the order will be automatically canceled. Any charges incurred during the bank transfer, imposed by the banks, are the responsibility of the customer.



You can pay for your order using cash on delivery upon its delivery, whether it is made by a courier or a shipping company, without any additional charges.



In the event that a refund of money is required (due to an eligible product return - please refer to our return policy), it will be processed by KOTSINAS using the same method that the customer used for the initial payment, unless otherwise agreed with the customer, without any undue or unjustifiable delay. If your payment was made through a bank deposit or cash on delivery, you will need to provide us with the IBAN of your bank account, with the account holder being the person who placed the order in our online store.

Returns due to delivery errors

In all cases where products are delivered different from those sold, either in terms of type or quantity, or if a previously agreed-upon characteristic is missing as documented in writing with KOTSINAS, the customer may return the products for inspection and verification of the error. In this case, the return costs to KOTSINAS, as well as the reshipment costs to the customer, are borne by KOTSINAS, provided that the recommended return method by the company is followed.


Returns of defective products

The products displayed in our online store may differ in color from reality due to various factors such as photography characteristics, lighting during photography, screen resolution, etc. Such deviations cannot be considered as deficiencies in agreed-upon characteristics or defects of the products you order. In the event that a manufacturing defect is identified, confirmed by the manufacturer or authorized repairer providing the warranty of good functioning, or if KOTSINAS directly provides the warranty of good functioning, the following apply:

The warranty is provided for a limited period of time as stated in the detailed specifications of the product. After the expiration of this period, repair or replacement of the products is possible with an additional charge, subject to a new agreement with the customer.

The return of the product for replacement should be accompanied by all the documents that were included with the product (e.g., receipt, retail invoice, etc.) and its complete packaging. If the defect is discovered after delivery and the packaging is not available, or if the product's packaging was taken by the distributors upon delivery, the packaging of the product is not required.

The return of products can be done either through our affiliated courier company, for products of small volume and weight up to 3 kilograms, or for larger products, through our affiliated transportation company at the KOTSINAS store. In cases of return through a transportation company, the customer is responsible for the shipping costs to KOTSINAS, and KOTSINAS is responsible for the shipping costs of the replacement or repaired product. If the existence of a defect or the lack of agreed-upon quality is confirmed, KOTSINAS will refund the customer for the shipping costs they have incurred, provided that they have used the affiliated transportation company.

After the return of the products, an inspection of the reported defect mentioned by the customer is conducted, followed by communication with the customer to provide them with updates regarding the results of the inspection.





Other rights you have in case of defective products:

1.    The customer is also entitled, within the legal or agreed timeframes and regardless of the following described right of withdrawal without cause, to exercise any of their rights provided by law due to product defects (repair, replacement, price reduction, or withdrawal) and, in accordance with the conditions set by law, by directly submitting a request to KOTSINAS.

2.    In case of a defect, you can fill out our returns form, which can be found in the "Returns" section at the bottom of our website, providing all the necessary details.

3.    Once a product is reported as defective by the customer, KOTSINAS explicitly reserves the right to diagnose the product as such, in order to either replace it with a non-defective one or repair it, if feasible.

4.    If the defect is minor, the right of withdrawal is not provided by law.

5.    If the defect can be remedied or replaced, the customer is obliged to accept the repair or replacement, unless it is unreasonable for them.

6.    Once a product is returned as defective and KOTSINAS confirms the existence of a defect after the aforementioned inspection, the customer can inquire about the progress of the replacement or repair.

7.    The assignment or transfer of rights regarding product defects is excluded.

In case of cancellation of the transaction, the refund of the original purchase will be made using the same method as the initial payment made by the customer to KOTSINAS. Specifically, in the case of credit card charges, KOTSINAS will be obligated to inform the issuing bank to cancel the transaction, and the bank will then proceed with any necessary actions based on the agreement it has with the customer, without any further liability on the part of KOTSINAS. After such notification, KOTSINAS bears no responsibility for the timing and execution of the refund, which is regulated by the relevant agreement. The chargeback process (full or partial) for credit card payments will be carried out in the same manner as the original card charge. In the case of payment via bank transfer, a reverse bank transfer will be made from KOTSINAS' accounts to the customer.

In case the products are returned damaged or incomplete, KOTSINAS has the right to refuse the return or request compensation from the customer. The amount of compensation will be determined based on the condition of the products, and KOTSINAS may unilaterally and without further notice proceed with a full or partial setoff of its claim against the customer.


Return of non-defective products - Right of unjustified withdrawal by the customer

If the customer is a natural person (consumer-individual) who makes the purchase for personal use and not for the purpose of their professional activity, then they are entitled to withdraw from the sale within 14 calendar days, starting from the delivery of the product (to the customer or to the carrier designated by the customer), by returning the product in its original condition, bearing the cost of return and any decrease in the value of the products. If you requested an invoice (sales invoice) at the time of placing your order (rather than a retail receipt), or if your order was submitted through the B2B section of our online store, we will consider that you are acting within the scope of your professional activity, and as a result, you will not have the right of withdrawal and other consumer protection provisions will not apply.

The withdrawal from a sale that was made with a natural person-consumer is subject to the following conditions:

This withdrawal is unjustified, and if the product has already been delivered, the customer must return the product exactly in the condition it was received, with all its components, accompanying documents, and packaging in excellent condition. The customer bears the cost of the return. The return of the product is accepted only after the buyer has first settled any amount charged by KOTSINAS for the delivery of the product to them, as well as the shipping costs for the return of the product.

The withdrawal statement can be made in writing or electronically, and KOTSINAS is obliged to send a confirmation of receipt of the withdrawal statement as soon as it is received. You can find the withdrawal form that needs to be completed here.

Following the withdrawal statement, KOTSINAS is obliged to refund the received amount within 14 days from the receipt of the products.

The refund to the customer will be processed through the same method of payment used for the initial transaction. Specifically, in the case of credit card charges, the following applies: if the payment has been already settled by the bank to KOTSINAS prior to the withdrawal and return of the product, KOTSINAS will be required to inform the bank about the cancellation of the transaction, and the bank will proceed with any necessary actions according to the agreement between the bank and the customer. After notifying the bank, KOTSINAS bears no responsibility for the timing and manner of the reimbursement, as it is governed by the agreement between the bank and the customer. The process of reimbursement for credit card charges follows the same procedure as the original card charge. In the case of payment through bank transfer, the refund will also be processed through a bank transfer to the customer's account.

The customer is responsible for compensating the company if they have used the goods in a manner other than necessary for determining their nature, characteristics, and functionality during the period prior to the declaration of withdrawal. The determination of the nature, characteristics, and functionality of the goods should be based on the information provided on the external packaging of each product, as well as any additional information provided by KOTSINAS, without opening the packaging of the products or putting the goods into operation. The company is willing to provide the customer with any information regarding the nature and functionality of the products, offering additional informational material through electronic or other means. If the packaging is opened, the value of the products is automatically reduced as the product is considered used, and the customer is required to compensate the company for the decrease in the value of the product. The reduction in value due to opening the packaging and subsequently designating the product as used is assessed on a case-by-case basis and determined by the company, usually ranging from 20% to 30%. KOTSINAS is entitled to reach an agreement with the customer regarding compensation, even through mutual settlement.

In case the products are returned damaged or incomplete, KOTSINAS has the right to reject the return or request compensation from the customer. The amount of compensation will be determined based on the condition of the products, and KOTSINAS may unilaterally and without further notice proceed with a full or partial set-off of its claim against the customer.


Exceptions to the right of withdrawal

There is no right of withdrawal for non-defective products in the supply of goods that are manufactured according to the consumer's specifications or clearly personalized.


Safe products - Warranty terms

If the products you purchased from us are machines, they bear all the necessary certifications for safe operation. These products are accompanied by written instructions for use (except for products that are straightforward in their use) and a written warranty of satisfactory performance for a reasonable duration, in the Greek language. The warranty document always includes the name and address of the guarantor, the product to which the warranty applies, its exact contents, duration, local scope of application, as well as the rights provided by applicable law. The warranty of the device lasts according to the manufacturer from the date of purchase and allows for free repair of any issues, provided that the following conditions are met:

·         There should be the warranty from the authorized dealer and the proof of purchase of the device.

·         The fixed elements of the device (Serial Number - Serial No.) should not have been altered.

·         The damage should not be excluded based on the manufacturer's warranty document.



The return process

1.    at the KOTSINAS store.

In this case, you can visit the store and, after the condition of the product is checked by the responsible staff member, they can guide you further.


2.    If you receive it through a transport company


You package the product in a larger box to ensure its protection during shipment. You send the package through the transport agency from which you received your order, and you ship it to our address.


Please note that the return costs are the responsibility of the customer.


We would like to inform you that in the event that the product does not meet the aforementioned conditions, it will be returned to the sender at their own expense.


3.    If you return a non-defective product exercising your right of withdrawal as a consumer within 14 days from the date of delivery:

8.    Product inspection upon delivery

Upon delivery, you are required to inspect the products you receive, as after that, you assume the risk of accidental damage, deterioration, or loss. Your signature on the delivery receipt signifies that you acknowledge receiving the products of your order correctly and that they are free from defects.

9.    Non-collection of products

If the customer does not collect the product within 30 days after receiving the notification for shipment and despite the relevant notification from the carrier, KOTSINAS reserves the right to withdraw from the sale. In such a case, the customer will receive a credit note of equal value to the sales price, minus the shipping costs, which will be refunded by KOTSINAS in the same manner as the customer made the payment.

For products that are provided upon special order and are custom-made specifically for you, non-collection of such products results in the loss of the paid price, and KOTSINAS will store them for you for a period of 2 months from the date of notification for their collection.

In case you express the desire to receive the products again, the expenses for their reshipment will be borne by you, regardless of the order amount.


10. Retention of ownership

Products that were delivered to you without being fully or partially paid for remain the property of KOTSINAS until the final, complete, and full payment of the price.

11. Consumer rights - Liability - Force majeure


1.    Consumer rights under the provisions concerning the sale of consumer goods and warranties of the Civil Code and the Consumer Protection Act, as well as any other relevant provisions, are applicable as prescribed by the aforementioned legal provisions. The liability of KOTSINAS for defects or lack of agreed-upon qualities is limited to a period of two months from the customer's receipt of the products.


2.    Claims by the customer for compensation or monetary satisfaction of any kind and legal basis are excluded. In particular, claims for damages to health, life, and physical integrity are excluded.


3.    Any claim for compensation or monetary satisfaction of any nature and legal basis is excluded in case of force majeure.



12. Protection of personal data

We would like to inform you that for the purpose of fulfilling our obligations arising from our transaction, we collect your personal data that you provide to us, which are exclusively kept for the fulfillment of these obligations and for compliance with legal obligations imposed on us (e.g., issuing lawful documents, submitting tax declarations, etc.). These data will not be disclosed to unauthorized third parties, except for our partners whose services are necessary for the execution of the contract (e.g., carriers, IT support companies, website hosting, etc.). All our partners have committed in writing to protect your personal data. Any customer data contained in returned products will be deleted by KOTSINAS and will not undergo further processing by them.

13. Final provisions


1.    These general terms and conditions are governed by Greek law.

2.    For any dispute between KOTSINAS and the customer, the competent courts of Thessaloniki have jurisdiction for its resolution. For out-of-court settlement of the dispute, you can also address the competent bodies for out-of-court settlement of consumer disputes, such as the General Secretariat for Consumer Affairs of the Ministry of Development and Competitiveness (Kaniggos Square, 10181, Athens,, tel: 1520, fax: 2103843549), the Consumer Ombudsman (, Alexandras Avenue 144, 114 71, Athens, tel: 2106460734, fax: 2106460414), the Committees for Friendly Settlement of Consumer Disputes (article 11 of Law 2251/1994) located in the municipalities across the country. Additionally, you can also address the European Alternative Dispute Resolution Body and use the relevant Online Dispute Resolution (ODR) platform of the European Commission:

3.    The protection provided by the laws governing distance contracts, as well as these terms and conditions, applies only to transactions involving natural persons for purposes that do not fall within their commercial, artisanal, business, or professional activities.

4.    In the event of non-application of any provision of this agreement, the remaining provisions remain in full force and effect.



14. Information and modification


KOTSINAS reserves the right to modify/update individual sections of these Terms without any obligation of prior notification. Please make sure to always read these terms before engaging in any transaction to stay informed about their current version in case there have been any modifications or updates.
